Litigation and Alternative Dispute Resolution

  • providing in-depth knowledge of intellectual property issues and litigation experience for effective client counselling on infringement avoidance and negotiated compromises, in accordance with our clients' objectives.

  • representing our clients in Her Majesty’s Courts in both the Province of Ontario and in the Federal Court of Canada, which have concurrent jurisdiction regarding intellectual property rights, and in the Supreme Court of Canada.

  • representing clients before related administrative tribunals concerning intellectual property rights and related matters including judicial review where necessary;

  • our litigation practice encompasses disputes involving intellectual property rights, misappropriation of trade secrets, unfair competition, breach of contract, trade defamation as well as defending against unjust enforcement of intellectual property rights. This practice includes interlocutory injunctive work, including ex parte relief, as well as trial and any necessary appellate advocacy.

  • directing effective enforcement campaigns internationally through our network of foreign associates.

  • working closely with appropriate police, Customs, and Crown counsel when criminal sanctions are warranted within Canada.
